CITY ATTORNEY RESPONDS TO GRAND JURY REPORT
City Attorney Ducts Independent Audit A 2004-2005 Grand Jury Report HIGHLY RECOMMENDED that the City Attorney,Barbara Liebold, have her billings audited and once again the Grand Jury has been wholly ignored by the attorney and the city council. Instead, the answer to that recommendation has been"Oh look at how wonderful our city attorney is and all the millions of dollars she have saved the city." This statement being made without one shred of verifiable documentation!!! And without any details as to how these wonderfull savings were accomplished!!! EM2,however, has documentation on MILLIONS of TAXPAYER DOLLARS were WASTED at the recommendations of our so called City Attorney's watch who, to this day swears that she is the attorney for the City Council not the City Attorney. The LOUSY excuses that have been given not to do the audit.......................................................... 1.) The City Attorney currently provides detailed billing of all activities performed. Ha! Ha! yea right!!! The public is unable to review the billings without blackouts on what was billed. 2.) The City currently retains an independent third party to audit the city's financial records every year. "BS"!! EM2 is aware that a regular auditor used yearly does not do INDEPENDENT AUDITS. That is a hogwash excuse!!! the auditors just scrape the surface on what is given them by the department heads no indepth detailed auditing is done. It is mostly random. QUESTIONS: 1.) How would the public know whether or not the so called detailed billing information is correct when the information is BLACKED OUT!!!!!!????? One cannot tell if what should only take 2hrs to do was actually charged to 10hrs of work. And how is it possible to charge the TAXPAYERS 50 hrs per week on one issue(40 hr work week) when many issues have also been charged to that same week??? The public have no accounting as to what is billed under the 50 hour per month retainer BASIC SERVICES oppossed to the hourly charges for SPECIAL SERVICES. The public has the RIGHT to know and determine this. IT'S PUBLIC FUNDS BEING SPENT. 2.) If an individual is HIRED to do a specific job for the city WHY ALL THE OUTRAGEOUS RETAINER FEES!!!??? HEY! GUESS WHAT!!! Now That the "Grand Jury Report Response" is already done and has been sent to the Grand Jury, (pack of lies), our wonderful City Attorney is going to hit the City up for a WHOPPING $1,500.00 retainer fee raise that would bring the retainer fee to $8500.00 per month. And also SHE wants a raise in services from $155.00 PER HOUR to $170.00 PER HOUR!!! Our City Council, gullible and pride riden that it is, will undoubtedly vote for these outrageous raises on Tuesday's meeting, September 27,2005, to keep everything covered up and going the same way, as always!!! THIS COUNCIL APPEAR TO BE VERY GOOD AT KEEPING WRONG DOINGS COVERED UP. They also appear to work infavor of corruption. FUNDS TAKEN WRONGFULLY BY STAFF. NO ONE IN FAVOR OF HAVING THE FUNDS RETURNED. FOLKS GET DOWN TO THE CITY COUNCIL MEETING AND SPEAK UP!!! YOUR HARD EARNED TAXDOLLARS ARE BEING SPENT WRONGFULLY. It starts at 7pm but you must be there to fill out a request to speak before the meeting gets started.

On behalf of the citizens and justice for all EM2 is calling for the district attorney Grover Trask in view of the council's refusal to comply with a Grand Jury's HIGH RECOMMENDATION TO AUDIT CITY ATTORNEY BARBARA LEIBOLD FINANCIAL BILLINGS. The District Attorney without hesitation should investigate the attorney's FINANCIAL BILLINGS. If the DA DOES NOTHING then take it to the State Attorney and the FBI. That this council would in an arrogant manne, FAIL TO COMPLY WITH A GRAND JURY'S FINDINGS!!! Citizens you have got to take the big step in big numbers to take a stand for yourself. It's your money. The city Trearurer is the only one attempting to protect the MISUSE OF PUBLIC FUNDS. But you the people who needs to understand that the Treasurer have a full time job like most of you do. Also a family. Yet he put in a lot of time at $ 150.00 per month battling with A council in which he should HAVE FULL SUPPORT from all of them but he do not and it is very frustrating having to dispute with thoes who should be FIRST IN LINE TO PROTECT PUBLIC FUNDS. They are not at all doing what they are elected to do. The CRIME SHOULD BE HELD AGANIST ALL OF THEM FOR ALLOWING PUBLIC FUNDS TO BE MISSPENT. BUT NOTHING WILL BE DONE for the most part, UNTIL THE CITIZENS COME TOGETHER IN THE CITY OF LAKE ELSINORE STEP UP TO THE PLATE IN DOING WHAT CITIZENS SHOULD DO TO PROTECT THEIR PUBLIC INTEREST. YOU MUST AT LEAST LET THEM KNOW THAT YOU TWO SUPPORT THE CITY TREASURERS POSITION. You should ATTEND THE COUNCIL MEETINGS AT THE CULTURE CENTER ON MAIN ST. 7PM. Sept. 27 tonight.
The city council obviously do not know how to direct the city's operations in a planned manner as all businesses are runned. question; Does all businesses have an attorney on call under a loose ended contract or agreement? I think NOT!!! Generally speaking why not have an organized work plan TIME LINE for Basic Services to the city? Much of what the city attorney is doing should be done by the qualified City Manager(Excutive Director)or his designated staff member. We should not need a city attorney in a manner of running the city. That is what the City Manager does run the city. The Council sets policies,laws with the help of the attorney and make approvals to be carried out appropriately by the Manager. Why do we need an attorney who is hired by the city under a retainer? Isn't a retainer for, in case something happens an attorney is on call as needed only? As noted in the city attorney's cites by comparison. As written it appears that those attorney's FEES are set on a hourly rate without a retainer. The city attorney noted hourly rates on city of Corona $180 per hour "Basic Services" and $195 for "Special Legal Services" City of Temecula pays $160 to $245 for, as the attorney noted, Legal Services depending on nature of services provided. City of Hemet pays "a" city attorney $235 per hour. And last. City of Banning $225 per hour. Notice city attorney Leibold did not make any RETAINER QUOTES. What a sneakie attorney to compare these cities with her RETANIER FEES OF NOW $8,500 per month Basic Services 50 hours monthly and $170 per hour for Special Services. By the total amount of her monthly billings $30,000 and sometimes way up the Basic Services appear to be charges under the Special Services hourly fees. That is why it is imperative that an independent audit is done on her billing style, finances.
Leibold FAILED to give the average total amount of monthly hours to each of those cities noted on there billings. Other words how many hours per month each city is billing for. Is that SNEAKIE or WHAT!!!!!!!
